LownDecor respects the intellectual property rights of others and expects our customers to do the same. If you believe that your intellectual property rights have been infringed upon, please follow the procedures outlined below.

DMCA Notice and Procedure for Copyright Infringement Claims

In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, LownDecor has adopted a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe the intellectual property rights of others.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide LownDecor's Copyright Agent with the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  2. A description of the copyrighted work that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the site;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification Procedures

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification to our Copyright Agent containing the following information:

  1. Your physical or electronic signature;
  2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
  4. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the United States District Court for the Southern District of Florida, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If the Copyright Agent receives a counter-notification, we may send a copy of the counter-notification to the original complaining party informing that person that we may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed content may be replaced or access to it restored, at our discretion, in 10 to 14 business days or more after receipt of the counter-notification.

Trademark Claims

If you believe that your trademark is being infringed on our site, please provide our Trademark Agent with the following information:

  1. Your physical or electronic signature (or the signature of the person authorized to act on behalf of the owner of the trademark right);
  2. A description of the trademark that you claim has been infringed;
  3. A description of where the material that you claim is infringing is located on the site;
  4. Your address, telephone number, and email address;
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the trademark owner, its agent, or the law; and
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the trademark owner or authorized to act on the trademark owner's behalf.

Custom Orders and Use of Third-Party Intellectual Property

LownDecor offers personalization services that allow customers to upload or request the use of custom content on products. By submitting or requesting custom content, you represent and warrant that:

  • You own all rights to the content or have express permission from the owner to use it;
  • Your use of the content does not infringe on any copyright, trademark, or other intellectual property right;
  • The content does not contain any defamatory, threatening, offensive, or illegal material;
  • You grant LownDecor a license to use the content for the purposes of fulfilling your custom order.

LownDecor reserves the right to refuse any custom order that appears to infringe on any intellectual property rights or violates our Terms of Service. For questions about what constitutes acceptable custom content, please contact our customer service team.

Notice of Trademark Usage

All trademarks, logos, and service marks displayed on LownDecor's website are either the property of LownDecor or third parties. You may not use these trademarks without the prior written consent of LownDecor or such third party that owns the trademark.

The name "LownDecor," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of LownDecor or its affiliates. You may not use these marks without the prior written permission of LownDecor.
